Family law in Texas is extensive, and the appeal process is no different. Any family law decision concerning child custody, property division, or child support can be appealed, although it is often a difficult process. One spouse or both spouses may seek an appeal or modification of a divorce judgment.

In family law cases, it’s not uncommon for one of the parties to be unhappy with the final decree. But in order to appeal a divorce judgment, there must be a basis for it showing that the decision made was an abuse of discretion. Appeals are time-consuming, and not every attorney is experienced in handling appeal cases. They must be filed within 30 days of the divorce decree or judgment. No new evidence will be considered, and only the evidence submitted for the district court case will be reviewed. The appellate court will verify that there was enough evidence upon which the decision was based or to determine if there was an error in the judge’s discretion.
