Use of Social Media During Divorce Proceedings

Use of Social Media During Divorce Proceedings

When you use social media, the first thing you need to keep in mind is that nothing you post is private. Once it’s on the Internet, it will remain there until electricity and computers die. People who are going through a divorce have enough stress without having to worry about what someone is posting on social media. However, these things can and will be used against you in a court of law. Even if your settings are airtight, a friend may make a screen grab and send it out to your soon-to-be ex.

Deleting posts won’t help your case. In fact, it may lead to charges against you because you’ve gotten rid of evidence. So even if those old posts come back to haunt you, it’s probably better to let them be rather than to have them come up as deleted in court. Chances are your spouse has a file of your social media activity, so deleting won’t help anyway.

There is a whole list of “Don’ts” for social media participation. It may be best just for you to go offline for the duration and come back when everything is done. However, if you have to use social media because it’s your social support network, then be sure that all of your posts are focused on you in a positive fashion. Do not post about your new love, your new car, your newfound happiness, or the amazing party you went to over the weekend. Instead, keep your posts lowkey and reach out to people IRL.

At the Law Offices of Steven C. Benke, we understand that divorce is a trying time for everyone involved. We work to find the best solution for our clients. Our experience in divorce and family law is undeniable, but it’s our commitment to providing you with the best preparation for all parts of the divorce that sets us apart from other law firms. Contact us to get a lawyer who knows the specific laws regarding divorce cases and who cares about you as a person. We will make sure that your divorce proceedings go as smoothly as possible while providing you with the support you need to get through a difficult time.
